COURT POSTPONES INTERIOR/EXTERIOR OPT OUT DATE AND FAIRNESS HEARING

At the status conference held on August 24, 2011, Judge Fallon extended the Opt Out Deadline and Fairness Hearing. The new Opt Out deadline is December 18, 2011 and the new Fairness Hearing will be held on February 3, 2011 at 9:00 am.

Chinese Drywall Supplier Banner Agrees to Pay $54 Million to Settle Claims

Banner Supply Co. agreed to pay $54 million to settle some claims by homeowners over allegedly defective Chinese drywall products.

Under the federal court settlement in New Orleans, Banner will deposit the money into an escrow account to resolve nationwide claims against the company.

The agreement also settles a suit by New Orleans Saints Head Coach Sean Payton and his wife, Beth Payton, over drywall contamination in their home at Mandeville, Louisiana.

Thousands of actions over corrosive drywall made in China have been consolidated before U.S. District Judge Eldon Fallon, who must consider fairness of the settlement.

More than 1.1 million sheets of harmful Chinese drywall were used in Louisiana rebuilding projects after hurricanes Katrina and Rita struck in 2005, state Attorney General James Caldwell has said.

In some cases, the drywall had to be removed and electrical wiring and fixtures were damaged by toxins including excessive formaldehyde in the wall covering.

The case is In re Chinese-Manufactured Drywall Products Liability Litigation, 2:09-md-02047, U.S. District Court, Eastern District of Louisiana (New Orleans).
